Sustainability is an increasingly important part of corporate social responsibility (CSR). In this context, supply chain management is becoming increasingly important for companies. This is reflected not least by the introduction of the Supply Chain Sourcing Obligations Act (LkSG) in 2021.

The LkSG will apply from 1 January 2023 to companies based in Germany with more than 3,000 employees. From 1 January 2024, companies with more than 1,000 employees will be covered. The law requires affected companies to implement human rights due diligence in the supply chain and to create a new function by appointing a human rights officer.

However, smaller and medium-sized enterprises (SMEs) that are not directly obligated by the LkSG are also indirectly affected in any case: Larger companies that fall under the scope of the LkSG pass on their obligations under the LkSG to their potential suppliers. This inevitably means that suppliers who have not had any supply chain management and have not implemented any human rights due diligence obligations in their own supply chain will have to have corresponding structures and processes in place in the future in order to even be considered as a contractual partner.
